Public Offer Agreement
PUBLIC AGREEMENT (OFFER)
for the ordering, purchase, sale and delivery of goods
This agreement between Dmytro Kovalenko, hereinafter the “Seller”, and the user of the services of the website, hereinafter the “Customer”, is an agency agreement for ordering, purchasing and delivering Goods, and sets out the basic terms of ordering, purchasing and delivering goods through the website https://qaacademy.net. The Buyer, acting with the aim of purchasing Goods, accepts the terms of this sale and purchase agreement (hereinafter the “Agreement”) on the following terms.
1. DEFINITION OF TERMS
1.1. A public offer (hereinafter the “Offer”) is a public proposal of the Seller, addressed to an indefinite circle of persons, to conclude with the Seller a distance sale and purchase agreement for goods (hereinafter the “Agreement”) on the terms contained in this Offer, including all Appendices.
1.2. An Order is the Customer's decision to order goods and their delivery, placed in the online store and/or an instruction to purchase and deliver goods.
2. GENERAL PROVISIONS
2.1. The information below is an official proposal (offer) of the internet portal https://qaacademy.net to any natural person (hereinafter the Buyer) to conclude a sale and purchase agreement for goods. This agreement is public, i.e. under Article 633 of the Civil Code of Ukraine its terms are the same for all buyers.
2.2. Under Article 642 of the Civil Code of Ukraine, full and unconditional acceptance of the terms of this proposal (offer), which confirms the conclusion of the sale and purchase agreement for goods on the terms proposed below, is the fact of placing and confirming an order.
2.4. By placing an Order the Buyer confirms his agreement to and unconditional acceptance of the terms of this proposal (offer).
2.5. By concluding the Agreement (that is, by accepting the terms of this Proposal (Offer) by placing an Order), the Buyer confirms the following:
a) the Buyer has fully read and agrees with the terms of this proposal (offer);
b) he gives permission for the collection, processing and transfer of personal data on the terms set out below in the Notice on the collection, processing and transfer of personal data; the permission to process personal data is valid throughout the term of the Agreement and for an unlimited period after its expiry. In addition, by concluding the Agreement the Customer confirms that he has been notified (without further notice) of the rights established by the Law of Ukraine “On Personal Data Protection”, of the purposes of data collection, and of the fact that his personal data are transferred to the Seller so that the terms of this Agreement can be fulfilled, mutual settlements can be made, and invoices, acts and other documents can be received. The Customer also agrees that the Seller has the right to provide access to and transfer his personal data to third parties without any additional notice to the Customer, without changing the purpose of processing the personal data. The scope of the Customer's rights as a personal data subject under the Law of Ukraine “On Personal Data Protection” is known and clear to him.
3. PRICE OF THE GOODS
3.1. The price of each item of Goods is indicated on the website of the online store.
3.2. The Seller has the right to change unilaterally the price of any subscription to the course. The price of an already purchased subscription cannot be changed.
3.3. If the price of the ordered Goods changes, the Seller undertakes to inform the Buyer of the change in the price of the Goods.
3.4. The Seller may not change the price of Goods that the Buyer has already paid for.
3.6. The Buyer's obligations to pay for the Goods are considered fulfilled from the moment the funds are received by the Seller.
3.7. Settlements between the Seller and the Buyer for the Goods are made in the ways indicated on the website of the online store in the section “PAYMENT”.
4. PLACING AN ORDER
4.1. The Buyer orders Goods through the online service of the online store website www.qaacademy.net
4.2. When registering on the online store website the Buyer undertakes to provide the following registration information:
4.2.1. the last name, first name and patronymic of the Buyer or of the person (recipient) he specifies;
4.2.3. an e-mail address;
4.3. The name, quantity, article number and price of the Goods selected by the Buyer are indicated in the Buyer's cart on the online store website.
4.4. If the Seller needs additional information, he has the right to request it from the Buyer. If the Buyer does not provide the necessary information, the Seller is not responsible for providing a quality service to the Buyer when purchasing goods in the online marketplace.
4.5. When placing an Order through the Operator (clause 4.1 of this Offer) the Buyer undertakes to provide the information specified in clause 4.2 of this Offer.
4.6. The Buyer accepts the terms of this Offer by entering the relevant data in the registration form on the online store website or when placing an Order through the Operator. After an Order is placed through the Operator, the Buyer's data are recorded in the Seller's database.
4.7. The Buyer is responsible for the accuracy of the information provided when placing an Order.
4.8. A distance sale and purchase agreement between the Seller and the Buyer is considered concluded from the moment the order is placed electronically on the online store website service or the Seller issues the Buyer a cash or sales receipt or another document confirming payment for the Goods.
5. TRANSFER OF THE GOODS TO THE BUYER.
5.1. Within 24 hours of payment for a subscription to the Galaxy QA Academy course, the Seller provides access to the course materials.
The period of access to the course materials and homework reviews is limited by the length of the subscription purchased by the Buyer (30 or 365 calendar days, depending on the goods paid for).
The Seller may provide, but does not guarantee, additional educational materials such as video conferences, video lessons, e-books, social media posts and so on.

6.2 Homework reviews. The course includes only the review of assignments given to the buyer in the course of study on the Seller's website. The Seller does not undertake to review additional work by the Buyer that is not part of the course.
The Seller undertakes to review homework within 24 hours of the moment the Buyer submits the assignment. In case of force majeure workload and a review deadline missed by more than 1 calendar day, the Seller undertakes to extend the Buyer's subscription FREE OF CHARGE by the amount of the lost review time.
7. RETURN OF GOODS
7.1. The Customer has no right to refuse goods of proper quality that have individually defined properties, if such goods can be used exclusively by the Consumer who purchased them (including non-standard sizes at the Customer's request and so on). Confirmation that the goods have individually defined properties is a difference in the sizes and other characteristics of the goods from those stated in the online store.
7.3 If the Agreement is terminated unilaterally at the Buyer's initiative, the funds paid by the Buyer as payment for the training during which the application for withdrawal was submitted are not refunded. The service is considered fully rendered at the moment the Buyer is given access to the training materials.
7. LIABILITY OF THE PARTIES
7.1. The Seller is not liable for damage caused to the Buyer as a result of improper use of Goods previously ordered on the Service www.qaacademy.net and purchased from the Seller.
7.2. The Seller is not liable for improper or untimely fulfillment of Orders and of his obligations if the Buyer provides inaccurate or false information.
7.3. The Seller and the Buyer are liable for fulfilling their obligations in accordance with the current legislation of Ukraine and the provisions of this Agreement.
7.4. The Seller or the Buyer is released from liability for full or partial non-performance of his obligations if the non-performance results from force majeure circumstances such as war or hostilities, earthquake, flood, fire and other natural disasters that arose independently of the will of the Seller and/or the Buyer after the conclusion of this agreement. The Party that cannot fulfill its obligations shall immediately notify the other Party of this.

PAYMENT
Payment for goods by natural persons.
Non-cash payment for goods by legal entities and other business entities.
Payment for the goods and for delivery (if necessary) is made through online payment systems. The Buyer may choose any payment system available in his region. After the funds are received in our settlement account, the subscription is created and access to the course is granted for the paid duration of the course.
The Seller guarantees to grant access to the paid course materials within 24 hours of the transfer of funds. During working hours the operation usually happens instantly.
GUARANTEES
We guarantee access to the course materials throughout the entire paid subscription period. The cost of homework reviews and of the teacher's help is also included in the price of the course and is provided within the validity period of the subscription.
